What the environmental classification or inquiry is

The environmental classification or inquiry is the procedure used to determine whether a specific activity is subject to any environmental intervention instrument (environmental impact assessment, environmental authorisation, activity licence, environmental notification) and, if so, exactly which procedure applies. It is particularly useful when there is uncertainty over the environmental intervention regime applicable to a given activity, since Spanish regional regulation classifies activities into different categories according to their potential environmental impact.

When it is needed

• When the developer is unsure whether the project is subject to environmental impact assessment, and under which route (ordinary or simplified).
• To verify whether an activity requires an environmental licence, environmental authorisation or only a prior notification under the applicable regional environmental-quality regulation.
• For projects with atypical characteristics that do not clearly fit the typically regulated cases, where a prior ruling from the authority is advisable.
• For modifications to existing installations, where it must be determined whether the change is substantial and requires new environmental processing.

How it is processed

1. Preliminary analysis of the activity and how it fits within the annexes of the applicable Spanish national and regional environmental regulation.
2. Drafting of the inquiry with a technical description of the activity, its location and its main characteristics.
3. Submission to the competent environmental body, usually regional.
4. Response from the authority, indicating the environmental intervention regime applicable to the activity in question.
